Technically and legally speaking it would violate the Outer Space Treaty to claim sovereignty over a celestial body, in part or in whole. HOWEVER, that doesn't mean we can't place a ceremonious flag on it since we'll likely get there first, and rule it de facto like we do the ISS and Antartica, while pretending like the Europeans are equal contributors (besides the Russians obviously), on paper.
This is all assuming that said treaty is even still intact by the time we're sending humans to Mars, especially for long term colonization which would necessitate a claim of sovereignty. I doubt the UN would even be intact by then, let alone the treaties they ratified.
