According to an international treaty that the USA signed and ratified in the 1960s, no penalty can be imposed on refugees who enter the country in search of asylum. People who arrive in the USA seeking asylum are committing no crime, regardless of how they get there.

They are not seeking asylum they have no problem traveling back and forth between countries to make sure their finances are in order back home (because refugees totally send a portion of their paycheck back to the country they claim to be fleeing???).
