Rights are something you are born with, that's why they are referred to as natural rights or God given rights. These would be true whether we are born in a pre civilization era, modern times, or post civilization era, because they always hold true. It is absolutely my God given right to defend myself and that can will hold true until the end of time. The same could not be said of a right requiring the labor of another. A constitution does not create rights out of thin air but rather it recognizes rights and defends them.

Not really. No one alive agreed to our constitution. It was a framework that sought to limit government power, and until recently it worked ok at doing that. With the understanding that the power of the state is to be restrained, asking where the power would be derived from is very relevant. If there is no power to do this, then the power does not exist. Why would you ever trust ANYONE that has power over you?
