They can't possibly be prejudged if the jury doesn't know their political beliefs. Likely, the trial will exclude all references to the defendant's beliefs or anything that didn't have to do directly with the crime and was very relevant.

Also, if the defendant went ahead with the swastika on his face, he could then file an appeal claiming he was discriminated against and that's why he lost the case, thus restarting the whole process.

The jury can't know who he is, or that he covered anything up. They will know nothing about him, except what the trial states. And in that trial, any evidence that he's a nazi or whatever, is excluded by law to not cause prejudice.

We've got competing and theoretically imcompatible constitutional rights here. One, the right to free speech. Two, the right to a fair trial. The judge is choosing a fair trial here - which is the right that the defendant dumbass has. It makes sense to temporarily suspend the free speech right so that this fucktwat doesn't expend more resources than necessary on multiple trials.

Don’t know if it’s been said yet but the defense REQUESTED the tattoos be covered to avoid prejudice against the defendant. This is a pretty common practice. Each state has different rules but in AZ it’s criminal rule 401b which basically says things of no evidentiary value can be precluded from the jury’s purview if they might be considered prejudicial.

This is a GOOD law because it prevents crooked shitty prosecutors from using every bad thing or *internet post* you’ve ever made from being presented to a jury when they have no bearing on the crime you’ve been accused of.
