The circuit above the guy could try to overturn it but he went out of his way to write a really damn long opinion with really strong evidence and a lot of examples, and if they do overturn it the law will definitely go to our supreme court, who will probably decide it's unconstitutional, and by nature of this, ban laws like that across the whole country. So it's sort of a win/win/lose scenario.
Either california and the whole west coast is uncucked, or we risk a gamble with the laws for the whole nation.
