there is nothing illegal about open bolt firearms.
the ATF asks that licensed manufacturers do not produce them, but:
a) that doesn't apply to private individuals
b) it also doesn't apply to open-bolt semiautos already on the market which are freely bought and sold just like any other semiauto firearm

Now making an machine gun of any sort would not be legal, but there is no law banning open-bolt semis.

That's the only way I design guns which I actually intend to make myself, unless it's a pretty small section.
Hot rolled shit like that won't work unless you're using some weird design where your precision surfaces aren't part of the receiver. I use cold rolled (drawn) round tubing which generally has a near polished finish. After you mill it, drill holes in it, etc it can be deburred and brought to any surface finish with the proper cylinder hone(s). Hot rolled tubing just isn't precise enough, it would be more of a pain to work with than drawn tubing.

open bolt itself isn't illegal, but guns that are easily converted to full auto fire are usually banned by name
of course, no company is going to spend time and money developing something that the ATF is going to b& a week before it hits the market

I've been kicking around an idea for doing so myself. Specially I've got an for a bullpup pistol caliber carbine that ejects from the bottom. I've also got an idea for a split bolt design that rides on an internal rail with geared teeth. I'll have to try it out with a prototype but I think this could let me build a much more compact action and bolt than you'd get from a simple blow back. Perhaps even a faster cycle rate as well.
