That is true, but only if both parties identify each other as armed combatants. If a criminal sees you as potentially armed, and you don't see him, then he will shoot, because he knows he will win the gunfight as he has the advantage. He will only not shoot if you're unarmed, as that's just a waste and causes attention, but he will use his piece to threaten you.
