To be fair, those companies make their money from licensing the engines and taking a percentage of game sales, Apple's business is entirely dependent on using the software as incentive to buy the hardware. Being able to fork the software for free and run it without the overpriced hardware would kill their sales.

If they forked from that one version (say the PPC build of Tiger circa 2004), it would be very difficult to maintain compatibility with software made to run only on future versions of the official OS -- it would effectively become the bastard child of an ancient macOS release -- not to mention that the continued development of the fork would require a level of organization and visibility that would inevitably be caught and shut down.

Apple only tolerates Hackintoshes as long as they remain a noncommercial hobby. Opening up all of iOS on a continued basis (under whatever terms) would create a thousand Chinese iPhone clone makers overnight that Apple would be powerless to stop without closing it up again.

My point was that Hacktinosh is only possible because macOS has been running on commodity x86 processors for the past decade or so. Over the past year, starting with the 2016 MBPs, Apple has been incorporating more proprietary ARM-based chips in new Mac models as hardware controllers and secure enclaves; it's only a matter of time before Hackintosh is no longer feasible, just like iPhone clones are unfeasible today due to all the proprietary Apple hardware inside.

See? There is no real way to prove Apple is any better than other companies participating in the PRISM project. It's not even worth considering.

Apple doesn't permit Hackintosh, I think they tolerate it so they can bolster their market share but it isn't something they'll support. Software that does that will have to run on top of the OS, which can hide anything from its software. The only way to do it is to monitor with a 3rd party device (e.g. your router) but there are many ways to masquerade traffic (for example only sending in someone's info when they try to connect to some apple service, regardless of if you notify them this is happening). You can never tell WHAT's being sent when it's encrypted.
