That's ultimately what it boils down to. American federal computer security is a fucking joke.

Back in the day, Gary McKinnon got into American military and NASA systems by writing a perl (or python, can't remember) script that basically knocked on machines saying "excuse me can I come in?" until it hit boxes with no password. He spent several months inside their systems before they detected him. Then suddenly he was supposed to have caused X amount of monetary value of damages to X number of systems that immediately triggered the right amount to get him extradited to the United States from the UK.

Someone doesn't spend months in a system undetected by breaking shit. What got him got was timezone differences. He forgot one day and logged into a machine he had access to while people where still in the office. Someone saw the machine operating on it's own and alerted security.

McKinnon also claimed that he wasn't the only one in their systems. There were IPs from China and Russia too. Look at China's new generation of stealth aircraft and their similarities to American technology. Yeah. But they can't demand Chinese hackers be extradited. It would be easier to extradite someone from a lap dog country and make an example of him to deter future hacking into their systems. And the fact that America operates prisoners for profit and the conditions inside them means they're going to find it much harder to have people extradited. The campaign to keep McKinnon in the UK was one of the biggest the country had seen against an extradition request.

Those laws are there for a reason.

Some of them are even there for a good reason. The CFAA is not one of those laws.

Yet some authors want their work to be restricted to certain publications. By distributing those works without permission, their rights and freedoms are being infringed upon.

Putting Mickey Mouse clauses aside, copyright law is there to protect the rights of the authors. Swartz broke the law, and because he was a big enough name in information freedom circles, the government thought it worth prosecuting him. Yes, it's tragic that he killed himself, but the prosecution could hardly be expected to have known that he would react in that way. They had simply done their job as they saw fit.

Freedom of Information is all very well, but ask yourself whether trampling on the wishes of other authors is the 'freedom' that you want.

Copyright laws are NOT there to protect the rights of the authors. They're there to protect the rights of the publishers, especially their rights to restrict the rights of their customers.

That's all well and good but you leave the best part out.
Those authors were paid by the government to do that research and write those publications. Therefore those works belong to the public (which is what publish means).
