The only reason they are warning about this is because they disagree with the US government in power right now and want to spread fear regardless of whether it's happening or not. The lefty takeover of the ACLU is a relatively recent thing, started around Ferguson I think. I used to be a member, but dumped them when they started having classes on how to riot. Now, they're becoming an anti-1st amendment org in the name of social justice, and I suspect that their stance towards privacy and surveillance will be similarly affected.
