Why is this even allowed?

Why does every neighborhood have these fucking assholes that broadcast 40mhz or 20mhz on overlapping channels (i.e not 1,6,11)? They just cause worse performance for everyone, including themselves. Why didn't the 802.11 standards just eliminate the ability to select overlapping subchannels?

i'm using 5Ghz, DFS, 80Mhz channel, and getting over 400mbps throughput with 2x2 devices.
