I remember the FBI prosecuting TOR users. I also remember them having to drop cases because their means of breaching TOR anonymity was classified and they didn't want to give it up to the judge and defense.

Because most criminals are brainlets. They don't actually think about their threat model, practice defense in depth, or keep their damn mouths shut about whatever mischief it is they're getting up to.

Trivial example: Remember that kid at Harvard who sent in a fake bomb threat to get out of an exam? He used Tor and an anonymous email service, but he was also the only person on campus connected to the Tor network at the time the message was sent. So he was a logical first suspect, and the questioned him and he confessed almost immediately. He could have tunneled his Tor traffic over a VPN (or an SSH proxy, or whatever) but he didn't consider the fact that he was using Tor might be discoverable or suspicious. Or he could have used Tor regularly throughout the semester, to create plausible deniability. He could have just gone down to a cafe or something and used Tor from there, instead of from his dorm room. (Bonus points for connecting to their wi-fi from across the street so you don't show up in their logs, if any, or in payment records or on security cameras) Or, once he'd been an idiot, he could have just had some balls and kept his damn mouth shut, in the knowledge that he was unlikely to be convicted based on circumstantial evidence, rather than any hard evidence that he sent the bomb threat.

Did he do any of those things? No. He didn't think farther ahead than "I have an exam today that I'm not prepared for". This lack of foresight is common among criminals (and the general population). If they were capable of learning technical things, thinking carefully, and planning well ahead, they wouldn't be caught. But they'd also be much less likely to have any motivation to do anything criminal in the first place.
