What if it was you or your family?

Why didn’t he just unlock his phone? Literally would get out of jail like that.

something something muh white race something

there's probably 10GB worth of cheese pizza in there

Because he's not a boot licking bending over cuck?
Because he respects his human rights to privacy?

Maybe he has pics of his own small penis there and doesn't want pigs to make fun of it?
etc.

Attached: cheese.jpg (400x293, 34K)

i could say the same about your phone.
in fact i could even report you to authorities hoping you get investigated because i just don't like your way of typing.
how would that make you feel?
you like this type of justice?

>why didnt he confess?

Guessing the officer saw him on his phone and wants him to prove he wasn't texting and driving, the dude in the OP won't do that so being held for that reason. The title is just him being a moron

>human rights to privacy
LOL

so why don't you send me all your files then bitch!??
you have no rights you criminal scum.

He metaphorically and physically refused to unlock his cell

Because I have the means and ability to keep my information private. If anyone really wanted to know me they would get that information.
You don't have a right to privacy. You just expect it and think you'll always have it.

I thought that wasn't allowed. Something about self-incrimination or something?

that's some edgy armchair analysis, friendo

They got a warrant.

this was bound to happen whether you like it or not. we're approaching a world where law enforcement basically can't do shit for computer based offenses other than making shit up and getting some jury to convict you for some meme obstruction of justice charge.

>human rights to privacy
USA

If it hasn't already, that case will get dropped. There is nothing on the books claiming you have to give up your password or biometrics to unlock anything. Self incriminating, pleading the 5th, etc. It's called innocent until proven guilty, not the other way around. The burden of proof is on them.

Meanwhile he rots in jail for 18 months already. They should just tag him and allow him to go about his business until the case is heard fully in court (none of this pretrial stuff).

>that case will get dropped
wrong.

Attached: 1984.jpg (754x302, 62K)

>IMA A MAN, BOY
>I STAND UP FOR MUH SELF BOY
LMAO meanwhile some faggot with a colored mohawk at the NSA has your passwords.
All in the name of national security.

>muh fluoride /x/oomer
yikes, you gotta lay off those astral projections, they're not good for your brain

Judges seem to be the exception to goverment power over citizens in the US, you walk into a courtroom and they can basically do whatever the fuck they want

that's in cuckistan

white people don't use phones silly, they chop wood in wheatfields with their families

Yeah but how else are they going to brow best him into submission and scare the rest of the masses into just doing what they're told when prompted?
That's a different case. The one in OP is was posted in 2018. Yours is 2017. And I could totally see something like that happening in the European Commie Bloc.

because of braindead zombies like you that this world in such a state.
you will get judged along with your wicked masters.

same country, year is irrelevant. same justice system.

The world's in tip-top shape and the qoomer rapture will never happen.

You have much to learn about "God", and the true nature of our existence.

His lawyer must be shit then. Round of applause for the garbage tier judge who thinks they're God himself demanding what is literally illegal.

>You don't have a right to privacy.
Explain how is this allowed on a ethical level, of course it can be set to practice irl cuz people are fucking stupid

If it were such a large ethical issue people would have cared in 2013. It's 2019 now.

>Jul 2018
What happened to the guy? Did he give his passcode?

He's right you know.
youtube.com/watch?v=m61FWj16Bvs

Found the full thing basically
>dude failed to yield got pulled over
>cop suspects drugs
>drugs found in car
>2 cell phones found in the car
>wouldn't unlock one
>warrant obtained via the local government
>refuses to comply with warrant on phone unlocking

>Found the full thing
then RTF follow-ups, you lazy cunt
>Judge jailed him for 160 days, or till he unlocked phone
>Turns out after 45 days, lawyer discovers 'drug test' (trace THC) was inadmissible BS as well
>got bored searching for end of story at that point, so, bite me
but, presume he got freed. Or disappeared

Really, they could jail him for what they've got already, but think they could lay more charges with evidence from his phones.

yeah. but legally you cant go on endless fishing expeditions, just because the guys an obstinate arse

Going to guess they wanted to find the potential dealer on the phone which is reasonable to assume one is a drug phone and the other a personal phone.

>refuses to comply with warrant on phone unlocking
The fifth amendment establishes that you do not have to provide evidence against yourself. Your phone passcode is testimonial evidence.

>not having a second password that makes your phone explode like a 60s James Bond gag

I agree, but one view is that it's not a 5th Amendment violation because the password itself is not incriminating, therefore it's similar to a subpoena

it's the wrong view, but my opinion don't mean dick to the government

yes sir pls i would like a chinese pizza very flavoured, double cheese if possible

as far as the courts and police are concerned, if you exercise your constitutional rights it is an admission of guilt, and they will fuck you even harder. I hope you can afford 30k for a lawyer because the constitution only applies to those that can.

>thinking.lawyers and judges arent slick enough to sidestep.this
its called "contempt of court" user

There are also several cases involving "foregone conclusion", in that the argument is made that law enforcement is already aware of the evidence in question, but it's unable to produce it formally due to encryption or some other form of lockout.

So what you're telling me is that refusal to unlock your device means it does contains incriminating evidence against you.

Isn't better to buy an small pendrive with good capacity, install Tails or a distro, use it in some PC with the hdd off and maybe add another proxy to it and when you are done using it you just hide the little thing? like you burry it in your garden or behind an electric plug, doubt someone will find that shit

They wouldn't need to go through all this for that though, the cop would just say "yeah I saw him texting and driving" and the judge would go "okay cool next case".

...

>guilty until proven innocent
You know that it's the other way around. Sure, you could argue "just unlock your phone", but you have the right to not unlock your phone and this is a court in a western country. But I don't know the case, so I don't even know if this is true.

But here is another reason why you should NEVER cooperate in such situations. Every country especially the USA has so many laws that literally NO ONE knows every law. Yes, not even the judges know every law. It could be that even if you literally have nothing "bad" on your phone, you still could violate other laws. For example if you use a VPN, it could be that there is a law which makes this VPN illegal because it has something minor which is against the law. Or you could have an account for a website which was also used by terrorists. This could make you a terrorist.

The state only wants to fuck you and if you aren't 100 % sure that you did nothing wrong (pro tip: you always do something wrong, even if the cop simply has to lie to fake a crime) you should never cooperate.

Here are some videos for you:
youtube.com/watch?v=d-7o9xYp7eE
youtube.com/watch?v=-FENubmZGj8

He shills his useless book which just says "pledge the 6th (I want a lawyer) not the 5th", but those videos are showing you that "I'm innocent" just means "I don't know how you will fuck me in the ass yet".

>say no
>go to jail
land of freedom

This is why everyone who defends criminalizing anything on the net even cp is a cuck

>own sister testifies against him
>already caught downloading pizza
By all means, let him rot.

>I forgot my password
Was this really so hard?
If that's what he did then the news is lying again.

>NO HE LIKES DIFFERENT STUFF THAN I DO JAIL HIM NANNY STATE

hope you get the same you would put on others scum

Do you know what punctuation is? I can't figure out what you're even trying to say aside from the fact that you don't like what I said.

As much as you may not like the law, the solution isn't to break it in order to make a point.

That is literally the solution. that is what this nations founders said verbatim, namely Jefferson.

Jesus youre a cuck.

I dont see what was hard to read about that.

Statistically there are more pedophilia instances in liberal states because of a more open attitude towards it.

Your argument against him is that he doesn't care for child pornography?

No the argument is he thinks someone belongs in jail for viewing something he doesnt like.

he can hand over the phone as per the warrant, but disclosure of the keys is protected under the fifth amendment

>That is literally the solution. that is what this nations founders said verbatim, namely Jefferson.
With enough support to get away with it.

What fucking statistics?

If you have nothing to hide. You have nothing to fear.

The Justice system looks for any way to incriminate you.

Can't he just say that it's not his phone?

i'd like it wrapped in russian collusion and interference

>gets beaten few doors later on in the same building

>>guilty until proven innocent
using evidence to disprove guilt is something lawyers tend to advise their clients to do for a stronger case
guess you can opt out if you feel like it though

oof
so sad for them

so glad I don't live in a police state desu

Colin looks so resigned to death.

You're an idiot if you think that being white makes you immune from this tyranny.

Dumb roastie just screwed over her brother for life by not keeping her mouth shut. If that man is going to jail, it better be for murder.

>it's another "glowniggers defend ignoring the fifth amendment and due process because icky pictures are alleged" thread
The laws that elites break don't matter. The laws that protect the general public don't matter. Thoughts on the actual tyrannical monstrosity that the US justice system has become? I hope you have good opsec Jow Forums.

Oh my gof

>black family testifying against family
>17 year police veteran
>"was shown hundreds of pictures and videos" (how do just "get shown" illegal porn in such a quantity by your brother)
>no hard evidence followed by illegal, indefinite imprisonment with no conviction
>zero updates after the minor news coverage 2 years ago (which was already 2 years into his imprisonment)
Everything about the situation reeks. Especially the fact that there is literally zero actual CP to convict this alleged pedo veteran cop with.

I just looked it up, he's free now.

attorneymyrtlebeachsc.com/2019/judge-locks-up-man-for-not-giving-cell-phone-password/

Not true at all

>cut off someone while getting on the freeway because they refused to use the empty fast lane
>get pulled over by the cops
>do not permit your vehicle being searched over a traffic ticket
>they get a dog to search your car anyway
>get taken to court for the ounce of weed in your armrest
>judge now demands the password for your phone
>plead the fifth
>get thrown in jail
Just another day in the LAND OF THE FREE

Attached: 1519519691518.png (247x248, 67K)

Not really related, but has there been an implementation of "Plausible Deniability" options with encryption on phones?

Also, has "Plausible Deniability" ever been tested in court?

'kay, never give an alibi
don't let them know where you've been

It's not 5th amendment if they have evidence showing what is most likely in there.

>evidence showing what is most likely in there
That's an arbitrary distinction. Letting government appointees arbitrarily decide when the 5th amendment no longer applies equals the 5th amendment no longer existing.

>You can send a man to jail for a reasonable doubt.
Sasuga land of freedom™

>unlock my phone
>it opens up to the couple gigs of weird porn I have on it and nothing else

Go ahead officer, you won't like what you will see and you won't find what you are looking for.
