Please read. The legal issue in USL v. BSDi was settled, yes: But it was *never* disputed that diff(1) and diff3(1) are AT&T proprietary. Those two were never distributed in 4.4BSD-Lite/-Lite2. FreeBSD used GNU diff until the Caldera ones happened. And that license is void after the SCO v. Novell disaster.
