Additionally, the premise of this lawsuit is shaky at best. On lines 15 and 16 of page 1 the complaint reads:

Apple has publicized this information and acceptance of this is also included in a copy of the ToS which endusers must agree to before using any Apple service.

Finally, another central point of this lawsuit asserts that Apple is not storing the data sent to them as stated within the ToS. However, the following is stated on Amazon AWS:

We do not access or use your content for any purpose without your consent. We never use customer content or derive information from it for marketing or advertising."

In legal terms, Apple is still the entity in "possession" (legally) of this data despite it being on another company's server. It's really clear that nobody here has any experience with contract law: embarrassing

I can attest to this with Dropbox, as I've used their service for over 10 years and watched their product gradually decline in both quality and functionality--not to mention the fact that their storage has absolutely no ability to scale whatsoever.

They just recently increased everyone's storage to 2TB in exchange for a $2/mo price hike. I've never used more than a terabyte, but if I want to connect a new device I have no choice but to use an old version of their software because all newer versions are broken and a) either wait literally 7 days for the device to sync or b) keep my files in the cloud (aka trust Dropbox. nothx). In other words, they attempted to justify a price hike knowing full well that their service does not work for individual users at scale.

I really want as much competition as possible, but the entire cloud storage industry looks like a podrace to the bottom. Apple's a shit company with a shit ethos, shit products and shit leadership, but if they're able to leverage these services such that the end user never has to experience how shitty they truly are...well, that's value added.
