It is blatantly retarded, because there was no intention of causing death (which means that it can't be intentional murder), because the death was not directly caused by him in any way and because the burglar who was killed is of legal age and therefore fully culpable for his own actions.
It's as if I had an argument with someone and told them to kill themselves, and was then charged with murder because they actually did it. It was not an intended consequence, it was not directly caused by me and the one who died died due to his own decision while being of legal age (if you're going to count choosing to go steal as what caused his death, and not the policeman, with which I do not agree).
