You are confusing things. The extra windows (don't know the name in English) was a thing during the second empire.
There was a tax for the number of floors you had, but the law did not apply to the roof floor. So people turn their roof floor in usable space.

There was a tax for the number of windows (the tax sky rocket after three) this is why so many buildings in central and eastern Europe only had 3 windows.
