Time was of the essence, as a prolapsed cord can cause fetal hypoxia. Laxman, who had not previously been involved in the patient's care, decided to perform a vaginal examination herself, and Patient A was placed in stirrups while she scrubbed. An ultrasound scan confirmed that cord compression had resulted in bradycardia, suggesting that only minutes remained to deliver the baby safely.

Laxman testified: "I remember thinking, should I try to deliver this baby. I still believe we had a very good chance of having the baby using other options than a C section but we had to act fast."

This, the tribunal found, was a serious clinical error that ultimately contributed to the baby's decapitation, although not to his death (witnesses agreed that he was already dead). As the baby moved forward, the cervix had gripped tightly around his neck. After trying to get him out through traction, with the mother in extreme pain, they gave her general anaesthesia and continued their efforts using incisions to widen the cervix. After an "increasingly desperate attempt" to deliver the head, the baby's body came out with the head detached, separating due to traction, an autopsy found. All witnesses agreed that the baby was dead before that happened.

The head was later delivered by hysterotomy and reattached so that the mother could hold the dead child. Other doctors performed that operation, as most of the staff present at the decapitation had been "overcome," said the tribunal chair, Tim Bradbury.

After being suspended by NHS Tayside, Laxman returned to work at a hospital in her native India and stopped obstetric work. But she returned to Britain for her hearing in Manchester.
