Yemen's government doesnt exactly enforce its rules.
Also, it has a long history of usage in the African Horn, from where it origianlly came, and Yemen. Yemenis have been consuming it for about 600 years.
Outside of Yemen though, there's no death penalty. In KSA, anyone who is seen in possession of Khat will either get jailed then deported or jailed then fined a huge sum of money.
