However, Harrington again closed the headgates in 2004 and refilled the reservoirs. As a result, OWRD and the Oregon State Police submitted reports to the Jackson County District Attorney’s Office alleging additional violations of Oregon water law. That office filed misdemeanor charges against Harrington, and in 2008 he pled guilty to one count. He was issued another fine, placed on one year probation, and was again ordered to drain the reservoirs.

Channeling and damming massive river systems and stocking them with fish is a little different than leaving a bucket outside while it's raining.

Even in a completely free market society, hoarding a free flowing resource like water can be adequately construed as a violation of the NAP. You don’t automatically acquire ownership of everything the moment it enters your property.

If it were discovered there is a single reserve of oil underneath both your’s and another person’s property, the amount of it in which you own isn’t the total amount in which you are capable of pulling out of the ground by drilling exclusively on your property. You’d only have the rights to whatever percentage of it exists under your land at the moment of it’s discovery. If for say only 10% of the oil is actually under your property prior to any drilling, that’s how much you get. You wouldn’t be able to say, “hah, I’ll race you sucker”, simply set up your drilling equipment faster than him and harvest a lions share of the reserve as oil on his side naturally flows to your side as you deplete it.
