a contract is created when the person signs a membership with the gym, agreeing to the gyms clauses and provisions as stated in the contract. if the gym says sometimes the gym will be closed for private functions with no recourse or refunds for other members, then tough shit. it sounds like an unlikely thing to be in a gym membership though.
