Yes, it could be. In fact I would not be surprised to find out if the large corps of the Linux foundation and their NSA handlers are behind the CoC ultimately. There wasn't really any straight line or justice in much of it. Correct, it is a kernel, whose funding is provide by many sources, including the Linux Foundation who pays Linus's salary and can fire or sanction him if he does things they don't like, such as repeatedly saying insulting things to other developers and refusing to stop even when asked many times.

They pay him a salary so he can work on it full time. They cannot prevent him from working on the kernel. Linus has been making lots of money for a long time, if he invested it intelligently he could probably work on the kernel full time without being paid at this point if he had too.

Why wouldn't he be able to get fired? Like you said he doesn't need to get paid by LF to keep working on the kernel. They should just let him go if he keeps being a burden, then he can get scooped up by Google or Microsoft or some other company that has a lot of experience quarantining developers who don't have social skills.

I don't think they can physically stop him from leading the project. It's not a company, it's closer to a charity, but even that isn't a terrible comparison. This style of economic activity doesn't have historical predecessors we can look at for reference.

They can't stop him from forking but they can absolutely stop him from making contributions to the project
